These Terms of Service govern your use of the Quick Assistance platform, operated by [LEGAL ENTITY NAME], a business registered in Quebec, Canada. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Quick Assistance is a technology platform that provides an AI-powered bilingual (English/French) receptionist service for businesses. The Service answers your incoming calls 24/7, captures caller information and sends SMS notifications, takes bookings on your behalf, and processes payments from your customers on your behalf (on eligible plans) using Stripe.
Quick Assistance is a technology and payment-facilitation provider only. We are the layer that answers calls, books appointments, and processes payments on your behalf. We are not a party to the services you provide to your customers.
You, the Business, are solely responsible for the services, products, experiences, and outcomes you provide to your own customers — including their quality, delivery, timeliness, and fitness.
Quick Assistance does not perform, guarantee, or take responsibility for any service a customer books with you. Any dispute, complaint, refund request, or liability arising from the actual service belongs to you and your customer. Our role is limited to facilitating the call, booking, and payment.
Subscription fees (what you pay us) are non-refundable once a billing period begins; access continues to period end.
Booking payments (what your customers pay you through the platform) are governed by your own business's refund policy. Quick Assistance facilitates these payments via Stripe but does not determine or issue refunds between you and your customers. See our Refund Policy for details.
On eligible plans, Quick Assistance processes payments from your customers on your behalf using Stripe Connect. You agree to complete Stripe's onboarding and identity verification. Funds are settled to your connected Stripe account, less applicable Stripe fees and the Quick Assistance platform fee.
You are responsible for the tax treatment of the services you sell to your customers, and for handling refunds and disputes with your own customers according to your policy.
You agree not to use the Service to violate any law, send spam or fraudulent communications, infringe others' rights, compromise platform security, or misrepresent your business. We may suspend or terminate accounts that violate this section.
We aim to keep the Service reliable but do not guarantee uninterrupted or error-free operation. The Service depends on third-party providers (telephony, payments, hosting). To the extent permitted by law, we are not liable for missed calls, bookings, or payments caused by outages or third-party failures.
To the maximum extent permitted by law, the Service is provided "as is". Quick Assistance is not liable for indirect, incidental, or consequential damages, or for lost profits, business, or data. Our total liability for any claim is limited to the amount you paid us in the three (3) months preceding the claim. Nothing here limits liability that cannot be limited under Quebec or Canadian law.
We may update the Service and these Terms. Material changes will be communicated by email or in-app. Continued use after changes take effect constitutes acceptance. If you do not agree, you may cancel.
These Terms are governed by the laws of the Province of Quebec and the applicable laws of Canada. Any dispute is subject to the jurisdiction of the courts of Quebec.
